Acceptance of Terms
By downloading, installing, and using the SyncDrive mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service following notification of changes constitutes your acceptance of the updated Terms.
Description of Service
SyncDrive is a mobile application that enables users to sync photos from their mobile devices to their Google Drive accounts. The Service provides:
- Photo selection and organization for syncing
- Automated backup of selected photos to Google Drive
- Sync status tracking and management
- Integration with Google Drive for cloud storage
The Service is provided "as is" and "as available." We make no warranties regarding uninterrupted service or error-free operation.
User Responsibilities
When using SyncDrive, you agree to:
- Use the Service only for lawful purposes and in compliance with all applicable laws and regulations
- Maintain the confidentiality of your Google account credentials
- Provide accurate and complete information when required
- Not attempt to unauthorized access, reverse engineer, or modify the Service
- Not use the Service to transmit viruses, malware, or other harmful content
- Respect intellectual property rights and not reproduce, distribute, or modify the Service without authorization
- Not engage in activities that could harm, overload, or impair the Service
You are responsible for all activity on your account and must notify us immediately of any unauthorized access.
Intellectual Property
SyncDrive and all its content, features, and functionality (including but not limited to all information, software, text, displays, images, and video) are owned by SyncDrive, our licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. This license does not permit you to modify, reverse engineer, create derivative works, or use the Service for any commercial purpose.
Limitation of Liability
To the fullest extent permitted by law, SyncDrive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability for all claims arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is less.
This limitation applies to all causes of action, whether in contract, tort, or otherwise.
Termination
We may terminate or suspend your access to the Service immediately and without notice if:
- You violate these Terms
- You violate any applicable law
- We determine in our sole discretion that continuation poses a risk to the Service or other users
Upon termination, your right to use the Service immediately ceases. We are not liable for any consequences of termination.
Changes to Terms and Service
We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We may also modify these Terms at any time, and your continued use of the Service constitutes acceptance of those modifications.
Material changes to the Service or Terms will be communicated to you via email or prominent notice within the application.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Vietnam for resolution of any disputes.
